Bhubaneswar: It is to mention here that Mr Nihar Ranjan Tripathy, the then ADM along with Mr Bhabani Shankar Ratha, the then Divisional Manager, P&GS Unit, LIC of India, Bhubaneswar committed the offence under Sections 354, 506, 509, 292 & 109 of Indian Penal Code by insulting, intimidating, mentally torturing, humiliating, showing disparaging gesture, using filthy language and outraging the modesty of a subordinate lady employee at her workplace. She filed the Complaint Petition bearing 1.C.C. Case No. 1693 of 2009 before the Learned SDJM, Bhubaneswar for taking cognizance of above offences against them. In view of order passed in the above complaint case, F.I.R. No. 158/ 2009 dated 3 September 2009 and G.R. Case No. 2328/ 2009 are registered by the Kharavelanagar Police Station, Bhubaneswar. Against the conclusion report of ICC dated 21 March 2009, the victim had approached before the Honorable High Court of Orissa through Writ Petition bearing No. WP(C) No. 6520/ 2009, which has been pending now for final adjudication. On basis of show cause notice served on opposition parties: 1. Mr Nihar Ranjan Tripathy; 2. The Chairperson, ICC; 3. The Chairman, LIC of India, Mumbai; and 4. The Senior Divisional Manager, LIC of India, Bhubaneswar Divisional Office in above case had already appeared before the Honorable High Court of Orissa.
Mr Bhabani Sankar Ratha, the then DM accused in the above GR case along with LIC Officers namely Mr Bimal Kishore Nanda, Mrs Anasuya Mishra, Mr Sarada Prasad Das, Mr Prasanta Kumar Mishra, Mr Radheshyam Meher, and Mr Muralidhar Das intentionally attributed sexual harassment on the lady employee at her workplace, thereby passing so many vague sexual remarks on her and by creating so many documents intersee with an intention to outrage the modesty of her who seen being suffering a lot from such nuisance till now, lastly made a Complaint dated 11/02/2010 to the DM, P&GS Unit, LIC, Bhubaneswar with copies to the SDM, BBSR DO and the Chairman, LIC, Mumbai for constituting an ICC for enquiring in to the allegations as per the ratio decided by the Honorable Supreme Court of India in the decided case of VISHAKHA. But, in spite of repeated representations, the LIC authority did not take any action to constitute the ICC to enquire the sexual harassment at workplace. She being petitioner approached before the Honorable High Court of Orissa through Writ Petition bearing W.P.(C) No.7576/ 2010 and the Honorable High Court was pleased to admit the above writ application and issued show cause notice to the Chairman, LIC, Mumbai; the Senior Divisional Manager, LIC Bhubaneswar Division and the Divisional Manager, P&GS Unit, LIC, Bhubaneswar which is now pending for adjudication.
As the victim did not get justice from LIC, she lodged a Complaint Petition bearing 1.C.C. No. 342/ 2010 against the above named accused officers before the Learned SDJM, Bhubaneswar on 30 January 2010. As per the order of the honorable court on 7 May 2010, the F.I.R. No. 125/ 2010 and on 11 May 2010 G.R. Case No. 1329/ 2010 are registered against the above mentioned seven LIC Officers under Sections 352, 354, 509 & 34 of I.P.C in Kharavelanagar Police Station, Bhubaneswar
Though through honorable court orders, FIRs are registered against the accused persons in Kharavelanagar Police Station, Bhubaneswar, till date the police filed no charge sheets in the above stated cases.
On 13 January 2010, the spouse of the victim had lodged one complaint against Mr Rabi Narayan Mishra, Senior Divisional Manager, LIC, Bhubaneswar Division for patronizing and abetting sexual harassment at workplace and requested the Chairman, LIC, Mumbai for taking urgent action on him, but, till today nothing had happened to it.
Even though in above two phases of incidences, cases are pending in honorable courts, as a poor lady employee, from beginning of the incident till date she had continuously drawn the attention of the LIC management for taking necessary action against the persons involved in the organized sexual harassment at workplace to her. That in view of guidelines settled by the Honorable Supreme Court of India in the decided case of VISHAKHA the Chairman, LIC did not act promptly to protect the lady from continuous sexual harassment at workplace and to create a conducive atmosphere to discharge her duty smoothly. After all, during the happenings of the incidents, the Chairman, LIC did not fit it proper to enquire the matter personally or through deputing any senior officer for case enquiry.
Because of pendency of above cases and crude mentality of top management of LIC towards a Class-III lady employee, any thing may happen to her person and mind at any point of time, fears her husband. So he had put his grievance and representation against the inaction of Mr T.S. Vijayan, Chairman, LIC in protecting the lady employee from organized way of continuous sexual harassment at workplace to Her Excellency the President of India. Copies are also submitted to His Excellency the Vice-President of India and Honorable Chairman, Rajya Sabha; Honorable Speaker, Lok Sabha; Honorable Prime Minister of India; Honorable Chairperson, UPA and President, Indian National Congress; Honorable Finance Minister, Govt. of India; Honorable Chief Minister, Odisha; Honorable Leader of Opposition, Lok Sabha; Honorable Chairperson, National Commission for Women; the Commissioner of Police, Bhubaneswar and the Chairman, LIC of India, Mumbai.
